Fill It Out Completely: Why the Alaska Property Disclosure Statement Protects You

If you’re selling a home in Alaska, state law (AS 34.70.010-.200) requires you to give the buyer a completed Residential Real Property Transfer Disclosure Statement before they make a written offer. Don’t rush through it. A thorough, honest disclosure is one of the best protections a seller has.

Why it protects you

The form is your written record of what you knew about the home and when you shared it. Most disputes after closing come down to one question: did the seller know, and did they say so? A complete disclosure answers that before anyone asks.

The stakes are real. A seller who negligently fails to comply is liable for the buyer’s actual damages. A willful violation can mean up to three times those damages, plus attorney fees. A blank section or vague answer can look like concealment, even when it was an oversight.

What you’ll need to document

  • Utility costs. Average monthly electric, heating fuel, water, sewer, and refuse costs. Gather a full year of fuel and electric bills so your numbers reflect every season, not just a mild month.
  • Repairs and replacements. Anything repaired, or needing repair or replacement, in the last five years: roof, heating system, water heater, plumbing, electrical, windows, and more. Keep dates and receipts.
  • Systems. Age and type of your heating system, fuel tank, water heater, sewer or septic, and water supply.
  • Alaska-specific issues. Freeze-ups, ice damming, permafrost or settling, flooding, erosion, and drainage.
  • Noise and flight path.  Most homes in Nome are in the flight path or affected by aircraft noise.
  • Other conditions. Leaks, mold, pests, past remodels and whether they were permitted, and environmental concerns. Homes built before 1978 also need lead-based paint paperwork.

Tips

Answer every question. If you truly don’t know, say so. A reasonable approximation is allowed if it’s clearly labeled as one.

Update if things change. If the information becomes inaccurate after delivery, you must provide an amendment.
